TERMS AND CONDITIONS:
We are in the market to bring buyers and sellers together.
UnitedBids is an auction business for Restaurant and Supermarket Equipment, Store Fixtures, Automobiles, Building Materials or Inventory, Metal Machining, Fabrication Tools, Manufacturing Equipment, Pallet Racking, Material Handling, Asset Recovery to the Medium and Small Businesses, Forklifts, Landscape Equipment, and other related items that may be owned or listed by a consignor. We value you business and look forward to making your purchase a rewarding experience. Our desire is that everyone gets a great deal. However, if you bid on the wrong item or decide an item is not suited for your intended use; Other Buyers should not absorb that cost.

When in doubt about condition, completeness, or suitability for intended use, please Inquire, Inspect, or Bid accordingly.
BUYERS PREMIUM:
A 15% buyer's premium will be added to each purchase.
If $100.00 is bid, at check out the buyer will be charged $115.00.
BIDS ARE BINDING:
All bids are binding and cannot be retracted.
DESIGNATED TIME FOR REMOVAL:
Scheduled removal time is posted online in the Event Details and NO refunds or
chargeback's will be granted due to non-removal of your purchased item by the
designated time. After the scheduled removal time, an item will be considered
abandoned and you will be charged a removal fee for disposal of your item.
SHIPPING PREPARATION AND HANDLING QUOTE (FOB) OUR LOCATION:
UnitedBids provides the estimated cost of shipping- preparation and handling for pick-up
at our location in South Fulton, TN 38257. If that service is desired by the Purchaser,
UnitedBids will add that cost to the amount of the purchase. We will prepare the item
for shipment as soon as possible and provide the availability date/time to the purchaser
by email. Method of shipment from our location is at the sole discretion and cost of the
purchaser.
PURCHASER PICK-UP WITHOUT HANDLING BY UNITEDBIDS:
Purchaser may elect to pick-up a purchased item at our facility in South Fulton, TN,
without shipping-preparation or special handling, except for transportation of the item
by forklift to the loading dock or vehicle.
PAYMENT:
Accepted forms of payment include Visa, MasterCard, Discover, or PayPal.
BID/BIDDING ERRORS:
Please be aware that some bidders routinely increase their bids to price an item out of
reach of other bidders. You should immediately review your bids once submitted.
We will not reverse bids after the auction has closed. (No Exceptions).
STAGGERED CLOSING:
The online auction closes at the rate of 10 items per minute. This feature
closes the bidding on intervals and works great with the auto-extend
feature to closely emulate a “live auction”.
DYNAMIC CLOSING:
The closing time of an asset is automatically extended an additional 3
minutes when a bid is placed within the last 5 minutes of the item’s
closing time.
BID NOTIFICATION:
If you have been outbid you will be notified by email UNTIL midnight of
the day previous to the last published day of the auction. To quickly
review your bids and see if you have won, you may utilize the “review
bids” feature. Items, on which you have been outbid, will be clearly
marked.
WINNING BIDDER NOTIFICATION:
Winners will be contacted by Email ONLY!!
If you feel you have won an item and have not
received an email you must notify us by email no
later than 10 A.M. (Eastern Time) of the next business day. If you did not
receive an email invoice then you have not won any items at
the online auction.
BUYOUT:
A “buyout” is an amount, in addition to a minimum bid, determined by
the seller that allows the potential bidder to purchase the item outright.
SALES TAX:
The Purchaser is liable for all sales tax. Sales taxes will be added and collected from the
Purchaser at the time of sell. If an item is on consignment, taxes will be collected for
the state where the item is located at the time of sale. It should be recognized that
UnitedBids is performing a service for the Purchaser in calculating and remitting sales
taxes. Each Purchaser shall indemnify UnitedBids against any tax, cost, or expense
relating to the failure of the Purchaser to satisfy any sales or use tax liability related to a
given transaction.
IMPORTANT TAX EXEMPT STATUS:
YOU MUST PROVIDE TO UNITEDBIDS A VALID TAX EXEMPTION
CERTIFICATE, FOR THE APPROPRIATE STATE. THIS MUST BE
PRESENTED BEFORE EVERY AUCTION ALONG WITH YOUR BIDDER
NUMBER AND THE AUCTION CLOSING DATE.
(Forms without this information will NOT be accepted and you will have to apply to the state for a refund.)
CAUTION REGARDING DIGITAL PHOTOGRAPHS:
For presentation purposes, equipment may be joined, co-located, in the photograph.
Do not assume a lot consists of more than one item simply because the items appear
connected and located with the same photograph. Be certain to inspect the lot numbers
and the descriptions.
You are bidding on the described item or items, not necessarily all items in the
photograph.
ITEMS SOLD AS IS:
All items are sold AS IS, WHERE IS, with NO EXPRESS or IMPLIED WARRANTY
associated with the lot number affixed to the item. This sale is to the business
community as "equipment and inventory" without warranty of any nature. We
strive to be accurate in the descriptions and provide exact visual details in the
photographs, but accuracy is not guaranteed. When you are not certain of the
condition or intended use of an item please bid accordingly, Always keep in
mind, YOU ARE BIDDING ON THE ITEM BASED ON DESCRIPTION!
REMOVAL:
Bidders are responsible for removal of items purchased. Any item
NOT picked up by the set time will be considered abandoned. Removal
shall be at the expense, liability, and risk of the purchaser. Purchases will
be released upon presentation of a paid receipt emailed directly from
UnitedBids. Please insure that movers or anyone picking up items on
your behalf have your paid receipt at the pickup location. No items will
be released otherwise.
Further, purchaser agrees to be responsible for all purchases associated
with their bidder number and agrees that items, not picked up by the
event removal times, will NOT be charged back.
DAMAGE:
Any damage caused by a potential bidder/purchaser, during the preview or during the
period of removal, becomes the responsibility of the bidder/buyer causing the damage.
Buyer agrees that the credit card number on file may be charged for any damages or
expenses and/or repairs to the pickup location or property of another buyer.
DISPOSITION OF ABANDONED OR UNPAID ITEMS:
UnitedBids reserves the right to dispose of, in a commercially reasonable manner, any
item not picked-up by the specified time, unpaid or determined to be abandoned. The
purchaser agrees to pay all deficiencies (measured by the difference between the final
bid and realized amount), legal, collection, transportation and storage expenses
associated with delinquent accounts or abandoned items.
FEE For DEFAULT and/or CHARGEBACK:
In the event of a default by a winning bidder and/or in the case of a chargeback
purchaser, than that party agrees that Unitedbids may collect a commercially
appropriate fee for items to be relocated, discarded or stored.
SELLER’S LIABILITY:
Any liability for UnitedBids shall be limited liability shall be limited to the refund of
bidder’s purchase price, taxes collected, and/or other fees previously paid.
ACCESS TO AND USAGE OF THE UNITEDBIDS WEBSITE
Registering as a Bidder, or any other use of the information provided herein, indicates agreement with these terms and conditions and supersedes any all prior or contemporaneous agreements with UnitedBids or its agents and representatives. If you do not agree with these terms and conditions, you may not access and use the information or services provided through the UnitedBids website. By registering, you represent that you are at least 18 years of age and have legal capacity. UnitedBids expressly reserves the right to terminate use of this website at its sole and absolute discretion. UnitedBids may amend these terms and conditions at its discretion. Any amendments become effective and binding when posted on this website.
Unitedbids reserves the right to add or remove items from the auction;
Split or combined lot;.
Add minimum bids or reserve prices;
Cancel, suspend, extend or reschedule an
individual item and or auction event;
Make changes to the auction closing times, inspection or removal times.
CONTROVERSY:
Any controversy or claim arising out of or relating to this contract and/or
agreement, or breach thereof, shall be settled by Either Small Claims
Court, State Court or Arbitration in accordance with the Commercial
Arbitration Rules of the American Arbitration Association, and judgments
upon the award rendered by the arbitrator(s) may be entered in any
court having jurisdiction thereof.
